The following presentation was given by Roger W. Clark to those chief executive officers who attended the CEO Effectiveness Group conference in Orange County, California on March 14, 2007. The focus of the presentation was: (1) protecting company brands; (2) protecting company trade secrets; and (3) protecting the company from unfair competition by competitors and former employees. The presentation was in Powerpoint liberally supplemented with commentary, responses to numerous questions, and handouts including the 148-page decision in Killingsworth v. Killingsworth, the trademark dispute which after trial resulted in the following relief for Roger's client: (1) an award of $1,616,387.46 in damages plus attorneys fees and costs; (2) an injunction; and (3) cancellation of the opponent's Federal trademark registration. There was a second trial in Killingsworth which resulted in the conviction of certain principals of Roger's opponent for criminal contempt for willful violation of the injunction.
